1. Basic information.

These terms and conditions apply to contracts created in the e-shop www.artrofitpowder.com between the seller and the buyer pursuant to Act no. 102/2014 Coll. on consumer protection when selling goods or providing services based on a contract concluded at a distance.

The buyer is the consumer, i.e. a natural person who, when concluding and fulfilling a consumer contract, does not act as part of the subject of his business activity of employment or profession. A purchase made by a business entity is governed by the Commercial Code no. 513/1991 Coll.

2. Order and conclusion of the contract.

Sending the completed order to the buyer is considered a proposal to conclude a contract according to the Civil Code, based on the seller’s offer in the e-shop. The contract is concluded by confirmation of the order by the seller.

3. Price and payment.

All product prices in the e-shop are final, including all taxes. The product price does not include delivery costs. These are listed on the page in the shopping cart even before the order is completed, where the buyer can also see the total price of the order, including the cost of delivering the goods.

You can use the following cards as a payment method: Visa, MasterCard, MasterPass, Maestro, GooglePay, ApplePay, Visa Electron and Diners Club.

4. Delivery of goods.

If the delivery date is not indicated with the product, the seller will deliver the goods to the buyer within 30 days at the latest. The goods are considered to be taken over by the buyer at the moment when the buyer or a third party designated by him (with the exception of the carrier) takes over all parts of the ordered goods, or if a) the goods ordered by the buyer in one order are delivered separately, at the time of taking over the goods that were delivered last, b) delivers goods consisting of several parts or pieces, at the moment of acceptance of the last part or last piece, c) delivers goods repeatedly during a defined period, at the moment of acceptance of the first delivered goods.

5. Exchange and return of goods.

Right to withdraw from the contract: If you enter into a contract as a customer, you have the right to withdraw from the contract within 14 days without giving a reason. The withdrawal period expires after 14 days from the day on which you or a third party other than the carrier and designated by you acquires physical ownership of the goods.

Withdrawal : If you decide to withdraw from this contract, we will refund all payments we have received from you (excluding shipping) within 14 days of the date of termination of this contract. We will process the refund using the same payment method you used for the original transaction, unless we mutually agree otherwise.

Changing the size: If you find that the size of the product you bought is not suitable for you, you can request a change of its size. You can request a change of size in an e-mail message where you select a new product size. After requesting an exchange and selecting a suitable return method, you must return the original product via courier. You must return the product immediately, but within a maximum period of 14 calendar days.

After choosing the method of returning the goods, we will send a new order with the goods in a new size, but in any case within a maximum of 30 days from this date. This new order is subject to the provisions in the terms and conditions, including the exercise of the right of withdrawal. Please note that if you do not return the original product within 14 calendar days from the date of submission of the request for exchange of goods, we have the right to charge you the corresponding amount of the new order placed, which is subject to the provisions of the terms and conditions.

6. Availability of products.

All product orders are subject to availability. In addition, if problems arise in connection with the delivery of products, or if additional items are no longer in stock, we reserve the right to provide you with information about similar products or to provide you with the option of withdrawing from the contract (cancellation of the order) via email. If you do not wish to order replacement products and wish to withdraw from the contract or cancel the order, we will refund any amount you have paid within 14 days of receiving the email.

7. Protection of personal data

The purpose of personal data processing is to use them to fulfill the consumer contract, which the seller concludes with the buyer by creating an order in this online store. This consumer contract is also the legal basis for the processing of the buyer’s personal data. The provision of the buyer’s personal data is a contractual requirement that is necessary for the conclusion of the contract. Provision of personal data is a condition for purchasing in the seller’s e-shop. If the buyer does not provide all the required personal data to the seller, this may result in not concluding the purchase contract.

For the purpose of fulfilling the consumer contract, personal data may be provided to third parties – delivery companies (couriers) and the company that processes accounting documents.

Personal data of the buyer is not published.

8. Delivery of goods

9. Settlement of disputes

The contracting parties have agreed that all disputes arising from the concluded purchase contract will be resolved by agreement or out-of-court proceedings, e.g. in the form of mediation. In the event that out-of-court dispute resolution methods are unsuccessful, disputes will be resolved (in writing and in an expedited manner) in accordance with the Arbitration Court of the Slovak Bar Association (hereinafter referred to as “RS SAK“) pursuant to Act No. 244/2002 Coll. on arbitration proceedings. Arbitration proceedings will be conducted in accordance with the legal regulations of the Slovak Republic.

The basic mission of RS SAK is efficient and fair adjudication of commercial disputes while respecting the equality of the parties to the proceedings. Dispute resolution is governed by clearly formulated rules. They are based on the basic long-term verified practices of internationally recognized arbitration institutions and on Act no. 244/2002 Coll. on arbitration proceedings.

10. Cancellation Policy:

– Cancellation within 24 hours: no fee
– Cancellation after 24 hours: 50% fee
– Cancellation after shipping: 100% fee

11. Refund Policy:

– Return of unopened product within 14 days: full refund
– Return of opened product: no refund
– Claims for damaged or defective products: full refund or replacement
